BOOKING AGREEMENT

GENERAL TERMS AND CONDITIONS

VILLA LE FONTANELLE ("the Property") As the person making the booking, you ("the Tenant" or "you" or "your") are responsible for the actions and behavior of all individuals (including yourself) in the group ("Group" or "Guests"). You are also responsible for obtaining their consent before providing us with their personal data.

1. Arrival and Departure Times

The standard check-in time is 4:00 PM and the check-out time is 10:00 AM, unless otherwise agreed with the owner. Early arrivals or late departures are subject to availability of the property and additional charges will apply. (by agreement)

2. Registered Guests

Only the number of guests specified in the booking contract at the time of booking may stay on the property. The number of guests specified at the time of booking is the maximum number of permitted guests. Should the owner or a representative of the owner ("the Representative") discover that an additional number of guests are residing on the property, it is at the absolute discretion of the owner or the Representative to request the additional guest(s) to vacate the property. Otherwise, each additional guest will be charged the published rate of 50 EUR per night. Camping is not permitted on the property or in the garden. The Tenant and all guests agree to comply with the rules and regulations of the property where the villa is located.

3. Minimum Stay Requirements

For most of the year, a minimum stay of one night is required. For the high season (June to August), the minimum stay is 5 nights.

4. Weddings and Events

For weddings and events, an event fee will be charged by the Tenant or the Guests. For the purposes of these General Terms and Conditions, an "Event" is defined as any gathering within the property that exceeds the maximum occupancy. All events and weddings must be organized by a professional planner. The property staff is unable to assist with the planning. An event plan must be submitted to the owner for approval at least 1 month prior to the wedding or event date. The maximum number for such events is 50 people.

5. Payment Requirements

When booking the accommodation, a non-refundable deposit of at least 25% of the total amount is due within 5 calendar days after the booking. The full payment amount is due 30 days prior to the arrival date.

6. Security Deposit

A security deposit is required by the owner prior to the arrival date. The deposit will be authorized on a credit card 48 hours before arrival or can be paid by bank transfer 10 days before arrival. The deposit will be returned or released to the tenant within 48 hours after check-out. Normal booking: 200 EUR. For events: 1000 EUR.

7. Cancellation Policy

Any cancellations made by the tenant are subject to the following penalties:

A) If the tenant cancels the reservation 30 days or more before the arrival date, all payments will be retained but credited for 9 months from the date of cancellation confirmation by the owner. The credit amount can be used by the tenant or another person on their behalf for any reservation, at any time, exclusively for the originally reserved property.

B) If the tenant cancels the reservation within 30 days before the arrival date, all booking payments will be retained. A full or partial refund is only possible if the owner receives another reservation that partially or fully covers the originally cancelled reservation.

C) For the high season, after the initial deposit and/or final payment, all payments will be retained. However, a full or partial refund is possible only if the owner receives another reservation that partially or fully covers the originally cancelled reservation.

D) If the tenant fails to make any further required payments or the remaining balance of the booking payment by the specified due date, all payments will be retained.

8. Changes

Any changes requested by the tenant regarding reservation dates after the booking confirmation are considered a breach of contract and will result in the loss of the booking agreement. All payments made are subject to the cancellation policy as outlined in clause 7 of these terms and conditions. Should the owner, for any reason, be unable to accommodate the tenant in the booked property (including the sale of the property and force majeure), the owner reserves the right to rebook the tenant and their group into an alternative accommodation of similar nature and value, upon agreement with the tenant. If the price of the replacement accommodation is lower than that of the original booking, the difference will be refunded to the tenant. If the price of the replacement accommodation is higher than that of the original booking, the difference may be charged to the tenant. However, if after reasonable efforts by the owner, no alternative accommodation of similar nature and value is available and/or no agreement can be reached between owner and tenant, both the owner and the tenant reserve the right to cancel the booking and this booking agreement. In this case, the owner will refund the tenant the entire amount for the unused booking without further compensation.

9. Tenant's Insurance:

All guests, including yourself, are required to have liability and comprehensive travel insurance that provides coverage including, but not limited to, cancellation, loss and damage of luggage and other belongings, as well as flight delays. All guests, including yourself, should also have medical insurance that includes evacuation and repatriation. Neither we nor the owner will be liable to guests, including yourself, for any claims, including accidents related to the use of the accommodation, facilities, or third-party services organized on-site such as water sports, boat trips, jeep or motorcycle rentals, etc.

10. Force Majeure:

In the event of natural disasters, strikes, war, acts of war, rebellion, riot, civil war, labor strike, trade restrictions, work stoppage, fire, accident, terrorism, or any other circumstances or actions beyond the reasonable control of the owner that prevent them from fulfilling their obligations under this Booking Agreement (such events hereinafter referred to as "force majeure"), we and the owner will be relieved from the obligations under this Booking Agreement for the duration of the force majeure event and shall not be liable for any delays or non-performance of obligations under this agreement or for any losses or damages that may be incurred by the tenant due to or as a result of force majeure.

11. Complaints:

In case of any issues or complaints during the booking period, they should first be discussed with the local staff. If the staff cannot resolve the issue promptly, please contact the intermediary, who will do their best to resolve the situation. We and the owner are not responsible for problems such as interruptions in water supply, power supply, internet connection, cable TV, or failures of elevators or pool filtration systems. The owner will do everything reasonably possible to avoid complaints in the first place, and it should be understood that the infrastructure, local standards, and conditions in less developed and remote holiday destinations are typically less developed than in urban environments. In the event of complaints, the tenant should address them in writing to the owner within 24 hours of the incident. Complaints submitted after check-out will not be considered.

12. Conduct:

As the tenant, you are responsible for the behavior of guests. If a guest behaves inappropriately, the owner and/or the intermediary may, at their discretion, ask the person in question to leave the accommodation. In such cases, there will be no refund to the tenant. Furthermore, the owner and the intermediary reserve the right to enter the accommodation at reasonable times to carry out repairs, maintenance work, or show the accommodation to potential tenants. We strongly recommend obtaining travel insurance to ensure financial protection.

13. Social Corporate Responsibility:

The unauthorized possession, use, or consumption of illegal substances is prohibited on the premises. Unauthorized behavior is also not allowed. In case of violations, the police will be notified immediately. In such cases, there will be no refund. For the safety of our tenants, our on-site staff, and the protection of the property, you and the guests are not allowed to bring persons of the opposite sex onto the property.

14. Accommodation Staff: The service of the staff is included in your stay from 7:00 am to 10:00 pm. Upon request and with prior notice, they are also available for late-night events or early morning breakfast (additional hours may be charged according to the accommodation's policies). It is at your discretion to give a tip upon departure. Additional services such as babysitting and chauffeur can be arranged in advance, subject to availability and additional charges. Requesting the staff to care for minor children is not permitted. The tenant must grant access to the property to staff members such as pool attendants and gardeners to perform their duties. If a change or addition of staff is desired, an additional fee of 75 EUR per person per night will apply.

15. Pets:

You and your guests are allowed to bring pets to the accommodation and the surrounding premises. The tenant is responsible for any damages or additional cleaning caused by the pets.

16. No Smoking:

Smoking is not allowed inside the accommodation. Smoking is only permitted outdoors on the premises where the accommodation staff can provide an ashtray.

17. Noise Disturbance:

Noise disturbance must be kept to a reasonable minimum, especially between 11:00 pm and 8:00 am.

18. Food and Beverages:

All food and beverages purchased for you and your guests will be charged at cost price plus a percentage markup. This markup covers the preparation of meals, transportation, time spent on shopping and cooking, as well as the use of the kitchen.

19. Bed Linen and Towels:

Bed linen and towels are provided by the accommodation. Due to our environmentally friendly "Save the Planet" policy, bed linen and towels are changed upon request only. Towels are replaced in the towel basket after use. Additional charges may apply if more frequent changes are required. Bed linen, laundry, or clothing should not be hung in places visible to other residents or common areas. Third-party laundry service for personal clothing can be arranged at the tenant's expense, and the owner is not liable for any loss or damage caused by third parties. The tenant is free to wash the bed linen or towels themselves.

20. Transfers:

All transfers can be arranged through our staff. Cost per one-way transfer is 75 EUR.

21. Utility Services:

The cost of utility services is included in the rental fee. Windows must be kept closed when using the air conditioning. The accommodation follows an environmentally friendly policy. Therefore, we kindly request that all air conditioning units be turned off when you and your guests leave the premises or spend an extended period of time outside the accommodation. The accommodation staff will adhere to this policy. However, if not respected, additional charges for the electricity bill may be applied to the tenant.

22. Furniture:

The interior furnishings must remain inside the accommodation, and only designated outdoor furniture may be used in the outdoor areas.

23. Insurance

The tenant must not do or allow anything that may cause the property's insurance against loss or damage by fire to become void or cause insurance premiums to be raised.

24. Duty of Care and Liability

It is understood that the tenant is responsible for the safety and well-being of themselves, guests, and all invited persons during their stay at the property. The tenant, guests, and invited persons must exercise due care during their stay and take precautions such as supervising children in the garden, near the entrance, and near or in the pool. All children must be under the direct supervision of an adult at all times. Neither the tenant, guests, nor invited persons are allowed to enter the property when wet from swimming, as floors may become slippery. Damages or injuries resulting from the above-mentioned scenarios are the responsibility of the tenant. The tenant indemnifies and holds the owner harmless from any claims that result from accidents leading to injury or death.

25. Valuables

Valuable items such as passports, cellphones, cameras, travelers' checks, cash, or jewelry should be stored in a safe deposit box provided in the property. Neither the owner nor the staff can be held responsible for any valuables left behind, lost, or damaged.

26. Artworks The tenant and guests must be aware that each property contains precious contemporary and antique artworks unique to the property, and they must take care to avoid causing any damage to them. The tenant is liable for any artworks or antiques damaged during the booking period, and the costs will be deducted from the aforementioned security deposit. If the damages exceed the security deposit, the tenant is liable for the remaining damages and must compensate the owner for the difference in cost. 

27. Limitation of Liability

Neither the owner, their agents, contractors, nor employees shall be liable for any loss, damages, destruction, injury, or death caused to any person (or any minor dependent of such person) or assets, property, or any item brought onto the property by the tenant, guests, and any invitees, regardless of how such loss, damages, destruction, injury, or death may occur, whether as a result of any foreseen or unforeseen event or any act or omission on the part of the owner, their agents, contractors, or employees or otherwise. Notwithstanding the foregoing, the tenant hereby indemnifies and the owner harmless against any claims brought against them relating to the agreement. In the event that the owner is held liable for any damages related to the booking, to the fullest extent permitted by law, your sole and exclusive remedy will be limited to the rental fee paid by you.

28. Miscellaneous

28.1 The tenant is not entitled to assign the booking to any third party without our prior written approval.

28.2 This Booking Agreement constitutes the entire agreement between the parties, and no warranties or representations, whether express or implied, not stated herein shall be binding on the parties.

28.3 Any indulgence shown to the guests shall not constitute a waiver or novation of our rights and rights of the owner.

28.4 Any contract made will be with the acceptance by both parties of these terms and conditions, which are governed by Italian law, and both parties submit to the exclusive jurisdiction of the Italian courts.
